Terms and Conditions

Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

1. Supplementary agreement: an agreement whereby the consumer acquires products, digital content and/or services in connection with a distance contract and these are supplied by the entrepreneur or a third party based on an arrangement with the entrepreneur.

2. Reflection period: the period within which the consumer may exercise the right of withdrawal.

3. Consumer: a natural person not acting for purposes relating to their trade, business, craft or profession.

4. Day: calendar day.

5. Digital content: data produced and supplied in digital form.

6. Continuous performance agreement: an agreement providing for regular delivery of goods, services and/or digital content during a specified period.

7. Durable medium: any tool, including email, that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.

8. Right of withdrawal: the possibility for the consumer to cancel the distance contract within the reflection period.

9. Entrepreneur: NOTICE B.V.

10. Distance contract: a contract concluded within an organised system for distance selling using one or more means of distance communication.

11. Model withdrawal form: the European model withdrawal form included at the end of these Terms and Conditions.

12. Means of distance communication: any method used to conclude an agreement without both parties being physically present in the same place.

Article 3 – Applicability

1. These Terms and Conditions apply to every offer made by NOTICE B.V. and to every distance contract concluded between NOTICE B.V. and the consumer.

2. Before the distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer electronically in such a way that it can be stored on a durable medium.

Article 4 – The Offer

1. If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated.

2. The offer contains a complete and accurate description of the products, digital content and/or services offered.

3. Obvious mistakes or errors in the offer are not binding on NOTICE B.V.

4. All images are a truthful representation of the products offered.

Article 5 – The Agreement

1. The agreement is concluded at the moment the consumer accepts the offer and complies with the conditions set.

2. NOTICE B.V. will confirm receipt of the acceptance electronically.

3. NOTICE B.V. takes appropriate technical and organisational security measures to protect electronic data transfer and ensures a secure online environment.

4. NOTICE B.V. may, within legal frameworks, verify whether the consumer can fulfil payment obligations and may refuse orders with justified reasoning.

Article 6 – Right of Withdrawal

For Products

1. The consumer may cancel a purchase within 14 days without giving any reason.

2. The reflection period starts on the day after the consumer, or a third party designated by the consumer (other than the carrier), receives the product.

For Services and Digital Content (not on a tangible medium)

1. The consumer may cancel within 14 days after conclusion of the agreement.

Extended Withdrawal Period

1. If NOTICE B.V. has not provided legally required information about the right of withdrawal, the withdrawal period expires 12 months after the original withdrawal period.

2. If the required information is provided within those 12 months, the withdrawal period expires 14 days after the day the consumer receives that information.

Article 7 – Obligations During the Reflection Period

1. The consumer shall handle the product and packaging with care.

2. The product may only be unpacked or used to the extent necessary to establish its nature, characteristics and functioning.

3. The consumer is only liable for diminished value resulting from handling beyond what is permitted in a physical store.

Article 8 – Exercise of the Right of Withdrawal and Costs

1. The consumer must notify NOTICE B.V. within 14 days via the model withdrawal form or by clear statement via email.

2. The product must be returned within 14 days after notification.

3. The consumer bears the direct cost of returning the product unless otherwise agreed.

4. The risk of return shipment lies with the consumer.

Article 9 – Obligations of NOTICE B.V. in Case of Withdrawal

1. NOTICE B.V. will refund all payments received from the consumer, including standard delivery costs, within 14 days after notification of withdrawal.

2. Refunds will be made using the same payment method unless otherwise agreed.

3. NOTICE B.V. may withhold reimbursement until the returned product has been received or proof of return has been provided.

Article 10 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for:

• Custom-made or personalised products

• Sealed products not suitable for return due to health or hygiene reasons if unsealed

• Digital content not supplied on a tangible medium if performance has begun with explicit prior consent

• Services fully performed with prior consent

• Products that deteriorate quickly

• Newspapers and magazines (excluding subscriptions)

Article 11 – The Price

1. Prices will not be increased during the validity period stated in the offer, except for VAT changes.

2. All prices stated on the website include VAT.

3. Delivery costs are clearly stated before checkout.

Article 12 – Performance and Additional Guarantee

1. NOTICE B.V. guarantees that products comply with the agreement and reasonable standards of quality.

2. Any additional guarantee does not limit statutory rights of the consumer.

Article 13 – Delivery and Execution

1. Orders will be executed with due care.

2. Delivery takes place at the address provided by the consumer.

3. Delivery will occur within 30 days unless otherwise agreed.

4. Risk transfers to the consumer upon delivery.

Article 14 – Long-Term Agreements

1. The consumer may terminate agreements concluded for an indefinite period at any time with a notice period of up to one month.

2. Fixed-term agreements may not be automatically renewed for a fixed duration unless legally permitted.

Article 15 – Payment

1. Payment must be made within 14 days unless otherwise agreed.

2. If payment is not made on time, statutory interest and reasonable collection costs may be charged after a 14-day reminder.

Article 16 – Complaints Procedure

1. Complaints must be submitted via hello@noticemestore.com.

2. Complaints will be answered within 14 days of receipt.

3. Dutch law applies to all agreements.
